  29. (The above applicant will be referred to as "USER") 
  30.  
  31. Conditions of access to GIF section: 
  32.  
  33.  
  34. (The term GIF is a generic term describing digitized images or 
  35. movies which are in a form capable of being transmitted over 
  36. modems and viewed with appropriate software by a computer.) 
  37.  
  38. The GIF section may contain pictures of nudity or sexual acts. 
  39. USER desires access to such materials. Accordingly, the USER
  40. agrees: 
  41.  
  42. 1) The BBS will not grant GIF access to any person below the age 
  43. of 21, and, may refuse access to any person who cannot be 
  44. verified as to age. 
  45.  
  46. 2) That USER will not share their password and other access 
  47. information, and will take reasonable steps to insure that their 
  48. password cannot be found by other users of their computer. If a 
  49. family uses the same computer, the BBS will provide a separate 
  50. password for adult users who are signatories to an application 
  51. and for under age applicants. 
  52.  
  53. 3) The USER will indemnify the BBS system from any and all claims
  54. related to files which USER downloads or uploads from or to the 
  55. BBS. That USER will take reasonable steps to insure that the 
  56. files cannot be viewed by persons below the age of 18. Such 
  57. reasonable steps could consist of, but are not limited to: 
  58.  
  59. 1) locking disks containing the files in a secure area, or,  
  60.  
  61. 2) using encryption so that GIF images received from this BBS are 
  62. enciphered and not accessible by others, or, 
  63.  
  64. 3) using password or other protection of access to the system, 
  65. or, 
  66.  
  67. 4) physically limiting access to the computer (ie., locking the 
  68. computer in a room or area not open to others). 
  69.  
  70. 4) That USER will not sell or otherwise commercially exploit the 
  71. files and their images received through this BBS. 
  72.  
  73. 5) In the event that USER uploads GIF's, the USER shall insure 
  74. that all persons depicted are over 18 years of age. Further,  that
  75. USER will verify that such files are properly distributable  (ie.,
  76. do not violate copyright). 
  77.  
  78. 6) That in the event USER has reasonable cause to believe that 
  79. any GIF viewed depicts scenes in violation of the law, that USER 
  80. will erase the same on their system and advise the BBS through a 
  81. private message to the systems operator (SYSOP) of USER's 
  82. concerns. 
  83.  
  84. 7) The BBS may bar a USER from the system for violation of these 
  85. rules. The BBS may in addition refer to appropriate authorities 
  86. any user transmitting unlawful sexually explicit pictures of 
  87. children. The BBS may discontinue provision of a GIF section at 
  88. any time in its sole discretion.
